Terms and Conditions of Sale

1. Minimum order quantity is one 20 or 40 foot container.
2. Quantities - +/- 10% of quantity ordered shall constitute compliance with the purchase order and the invoice shall be adjusted according to the quantity actually delivered. (Occasionally a pallet gets left at the port due to weight restrictions.)
3. Different widths/grades from the same mill may be mixed on one order, subject to each individual mill's policy and product availability. Please contact your WFEX representative for details.
4. All buyers, except those choosing to pay by Deposit w/Order or Balance before Delivery Terms must fill out a credit application and be approved for credit, prior to WFEX accepting your order.
5. If credit is denied or you do not wish to fill out a credit application, purchases may still be made but only on the following terms:
   1. Deposit w/order, balance before delivery: A 25% cash deposit must be made at the time your order is confirmed by us. You will be invoiced for the balance when your order arrives at the specified destination port. The balance is due prior to customs clearance (five days after arrival in the US).
6. Prices as set forth in the Sales Order you signed are subject to the following conditions:
   1. Should duty rates change after shipping the goods to WFEX as a result of any new governmental duties or other such charges imposed upon the shipment, for such additional costs WFEX reserves the right to request these costs to be added to your invoice. You then have the right to either accept or decline the shipment at the new price. Should you decline WFEX has the right to sell the container elsewhere.
7. Delivery – all delivery dates quoted are approximate. WFEX shall not be held liable for any damages or losses caused by delays in shipment/delivery caused by accident, labor disturbance, lack of shipping facility, port strikes, truck strikes, vessel sailing schedule changes or delays, mill delays, material shortages, acts of God, customs and agriculture department inspections, etc., which are beyond WFEX’s control.
